Terms of service

These terms apply when you use Service Broker. Service Broker is a business name of Colin Dixon trading as Service Broker, ABN 68 758 286 944, Mallacoota VIC 3892 ("we", "us"). "You" means the person or business we do the work for. Questions: 0419 415 000 or help@servicebroker.com.au.
1. What we do
- Cost reviews and cost cutting: we review what you pay regularly (subscriptions, internet, phone and mobile, utilities, banking, insurance, business email and IT), recommend changes, and help you switch or renegotiate.
- Websites, domains and care plans: orders placed through domains.oze.au are also covered by the terms on that site.
- Accounting and payment systems setup and help, and IT help.
We give general information and recommendations about prices and services. We don't give financial, legal or tax advice (see our disclaimer).
2. Free cost review and website check
The free 15-minute call, the review of your bills and the free website check and quote cost nothing and you're under no obligation to go ahead.
3. Prices and quotes
- Prices are a guide, open to negotiation and subject to change. The price that applies to your job is the one we agree with you in writing (email is fine) before we start.
- All prices in AUD. No GST applies. We are not registered for GST, so we don't charge GST.
- IT help, including accounting and payment system setup, is $120 an hour unless we agree a fixed fee.
- Travel: $1 per km when the job is more than 10 km from our base in Mallacoota. No travel charge within 10 km.
- For cost-cutting work you can pay by the hour or, where we offer it, on results (a fixed fee covered by our guarantee, or a share of the savings). We agree which in writing before we start.
4. Our guarantee
Our fee will be less than half of what we save you in the first 12 months, or you pay nothing.
How it works:
- Agreed in writing first. Before we start, we agree in writing: the services in scope, what you pay for them now (the "baseline", taken from your recent bills), our fixed fee, and how the savings will be worked out.
- Settled on the expected savings. The guarantee is worked out on the expected savings: what we expect you to save over the 12 months after each agreed change takes effect, calculated from your recent bills and agreed with you in writing before we start. It applies to those agreed expected savings provided you go ahead with the agreed changes. It is not re-measured against your actual bills afterwards.
- Note: your actual savings can change with your usage (for example, using more or less power or data) and with later price changes by your providers. That doesn't change the guarantee.
- Changing providers. Getting the savings may mean changing providers. We're happy to help with the switch, and only ever with your agreement.
- What counts as a saving: the expected difference between the baseline and what you'll pay for the same or an equivalent service after the change, including lower plan prices, services you no longer pay for because you didn't need them, lower bank or merchant fees, and refunds or credits we recover for over-billing.
- What doesn't count: changes you make yourself outside the agreed plan; government rebates or concessions; and any new costs you choose to add.
- Costs of switching such as exit or break fees that you agree to pay are subtracted from the savings, and we tell you about them before you decide.
- If you don't go ahead with the agreed changes, the guarantee doesn't apply to the changes you don't make. If you make only some of them, it's worked out on the expected savings from the changes you do make, unless we agree otherwise in writing.
- If an agreed change can't be made (for example, a provider won't offer the price we expected), we work out the expected savings again, the same way, for the changes that are made. If our fee doesn't meet the guarantee for those savings, you pay nothing for that job; if you have already paid, we refund the fee in full.
5. Share of the savings
Where we agree a fee based on a share of the savings, the savings are worked out the same way as in section 4 and the percentage and invoicing dates are agreed in writing before we start. No savings, no fee.
6. When fees are payable
- Hourly work: invoiced when the work is done (or monthly for longer jobs), payable within 14 days.
- Guarantee fixed fee: invoiced once the agreed changes have taken effect and the first bill shows the new price, payable within 14 days. Refunded in full if the guarantee isn't met (section 4).
- Share of the savings: invoiced on the dates agreed in writing, payable within 14 days.
7. What we need from you
- Accurate information and recent copies of your bills (usually the last 2 or 3).
- Where we need to talk to a provider for you, a signed letter of authority. It only lets us do what you tick, for the time you choose, and you can cancel it at any time.
- Decisions about changing services are yours. You sign up with, and pay, providers directly.
8. Other providers
Providers' own terms, prices and service levels apply to the services you buy from them. We're not responsible for their outages, mistakes, price changes or decisions, but we'll help you deal with them.
9. Your rights under Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be provided with due care and skill. Nothing in these terms excludes, restricts or changes those rights.
To the extent the law allows: where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited to supplying the services again or paying the cost of having them supplied again; we are not liable for indirect or consequential loss; and our total liability for any job is limited to the fees you paid for it.
10. Stopping work
You can stop a job at any time by telling us. You pay for hourly work done up to then. If you stop a guarantee or share-of-savings job after we've started, we'll agree a fair fee for the work done, which won't be more than the agreed fee. Care plans can be cancelled as set out on domains.oze.au.
11. Privacy
We handle your information as set out in our privacy policy.
12. General
We may update these terms; the version on this page when we agree a job applies to that job. These terms are governed by the laws of Victoria, Australia.
